In February 2020, an Ontario court judge ruled that the charges against Tiffany Anwar and her husband, who ran Fantasy World Escorts until shut down by cops in 2015, violated the charter. Justice Thomas McKay ruled that the laws, which prohibit procuring, advertising and materially benefiting from someone else's sexual services, are unconstitutional. In his ruling, the judge said the laws were so broad, they prohibited sex-trade members to work co-operatively with each other or with others in non-exploitative relationships, and exposed workers to an increased risk of exploitation.
The Canadian Alliance for Sex Work Law Reform, including Tiffany and other workers and advocates, have launched a second constitutional challenge to the prostitution laws. This comes eight years after the Supreme Court of Canada struck down the former law because it put workers in danger. The group filed legal paperwork on March 30, 2021 in the Ontario Superior Court of Justice.
