On June 29, 2023, the conservative-led Supreme Court struck down race-based affirmative action in higher education. While the ruling was limited to higher education, litigants have used the ruling to attack DEI initiatives in the private sector. We have done a previous episode on the Fearless Fund lawsuit and a settlement was reached in September.
