There is a basic misunderstanding that the law is based on right or wrong. That could not be further from the truth. The truth is that the legal system is not fair.
So does that mean that you cannot win your case? Absolutely not. In fact, once you get a good understanding of who and what you are dealing with, that is when you will really be able to use the legal system to work in your favor. The reason so many debt buyers (debt collectors) file frivolous lawsuits, is because they understand how the legal system works. It just takes 1 intimidation tactic from them to the consumer to discourage the consumer from responding to their lawsuit, and then they can use the system to achieve their end goal (default judgment).
This is the 1st episode in this series that will help prepare you on how to approach your debt collection lawsuit. Upcoming episodes will be on 1) how to hire the right attorney to fight your case and 2) what to do if you cannot afford an attorney (self-representation). Stay tuned!
